Additional Complaint Mechanisms

New York Tech’s internal complaint procedures for students are described in the Resolve a Problem page.

As a recipient of Title IV federal funding, New York Tech provides information on filing complaints outside the institution in cases where satisfactory resolution cannot be reached internally.

The New York State Education Department and the Middle States Commission on Higher Education are the primary agencies responsible for managing student complaints outside New York Tech. Both have policies regarding the scope and process for filing complaints:

New York State Education Department
Office of College and University Evaluation
89 Washington Avenue, EBA Room 960
Albany, NY 12234
Complaints may be filed with the Department using this form

Middle States Commission on Higher Education
3624 Market Street
Philadelphia, PA 19104
Phone: 267.284.5000
Complaints may be filed with Middle States using this form

Students attending NYITCOM at Arkansas State may contact Middle States or the Arkansas Department of Higher Education:

Arkansas Department of Higher Education
423 Main Street, Suite 400
Little Rock, AR 72201

Complaints may be filed with the Department using this form

New York Tech is also a member of the National Council for State Authorization Reciprocity Agreements (also known as, “NC-SARA”) for the provision of distance education courses across state lines. This means when a complaint related to distance education activities from an out-of-state student cannot be resolved at New York Tech, the student may file a complaint under the NC-SARA process.

This process applies to complaints of dishonest or fraudulent activity, including the provision of false or misleading information by the institution.  Since the institution’s home state is New York, NC-SARA vests authority for complaint investigation and resolution with the New York State Education Department. While the Department may enlist the assistance of other entities in the state, it retains final authority over these complaints.

Students studying under NC-SARA have two years in which to appeal an internally filed complaint with the New York State Department of Education. Complaints about grades or student conduct violations cannot be addressed through the NC-SARA process. (See SARA Policy Manual, version 24.2, December 16, 2024, Section 4. Consumer Protection.)

Complaints may also be addressed to New York Tech’s programmatic Accrediting Agencies
